These Terms of Use ("Terms") govern your access to and use of https://aqualispublishing.com (the "Site"). The Site is operated by X Enterprises, LLC. Aqualis Publishing is a DBA of X Enterprises, LLC, 18122 3rd Dr SE, Bothell, WA 98012.

Music and book availability, platform links, and licensing discussions are informational or commercial outreach. They do not create a license until we confirm terms in a separate writing if a license is offered.

These Terms do not grant you a license to copy, distribute, publicly perform, sync, or create derivative works from our catalog except as we expressly allow in a separate written license or as mandatory law requires. Sync and other licensing requests go through contact channels and are not granted merely by browsing.

Third-party links, platforms, and tools

The Site may link to third-party sites and platforms (for example Apple Music, Spotify, LANDR, Bandmate, or other services). Those services are not under our control. Your use of them is governed by their terms and policies.

Copyright complaints

If you believe content on the Site infringes your copyright, send a notice to hello@aqualispublishing.com with enough detail for us to locate the material and respond. We may remove or disable content and, where appropriate, terminate repeat infringers.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). Indemnification

You will defend, indemnify, and hold harmless X Enterprises, LLC and its DBAs, officers, directors, employees, and agents from and against claims, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to your misuse of the Site or your violation of these Terms or applicable law.

Dispute Resolution; Binding Arbitration; Class-Action Waiver

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Except for disputes that qualify for small-claims court and except for claims seeking injunctive or other equitable relief for intellectual-property infringement or misuse, any dispute arising out of or relating to these Terms or the Site will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The seat of arbitration will be King County, Washington, unless you and we agree otherwise. You and we waive any right to a jury trial and any right to participate in a class, consolidated, or representative action. If this class-action waiver is found unenforceable as to a particular claim, that claim must proceed in court and not in arbitration. Either party may seek provisional relief in court to protect intellectual-property rights or to prevent irreparable harm pending arbitration.

Governing law and venue

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules. Subject to the arbitration section, exclusive venue for permitted court actions is the state or federal courts located in King County, Washington, and you consent to personal jurisdiction there.

Changes

We may update these Terms by posting a revised version on this page with a new "Last updated" date. Continued use after the effective date constitutes acceptance of the revised Terms, except where mandatory law requires a different process.

Miscellaneous

These Terms, together with the policies incorporated by reference, are the entire agreement between you and us regarding your use of the Site. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our prior written consent. We may assign them. Section headings are for convenience only.
